THIS IS A CONTRACT

 

  1. The Bidder’s signature confirms that the Broker/Agent represents them. The bidder knows that the Broker may receive compensation from the transaction's proceeds.
  2. The commission paid to the registered broker/agent shall be 2.5% of the client’s winning bid for the real estate, not including the buyer’s premium or other fees, if applicable.
  3. To be entitled to any commission or referral, the Broker/Agent must:
    1. Register his/her client by filling out the BUYER’S BROKER AUCTION REGISTRATION FORM in full, including the signatures of the Bidder and Managing/Principal Broker.
    2. Submit the Buyer’s Broker Auction Registration Form to FourSquare Auctions ( ad***@4s*********.com ) no later than 24 hours after the Bidder’s Registration with the Auctioneer but by no means later than 24 hours before the auction closing.
    3. Broker/Agent agrees that upon endorsement of this agreement, they certify, agree, and acknowledge that:
      1. The broker/Agent will not claim any exceptions to the procedures outlined in this document unless mutually agreed upon, as evidenced by the signatures of the Broker/Agent and Auctioneer.
      2. No oral or implied registration will qualify the Broker/Agent for participation.
      3. The Broker/Agent agrees, understands, and will follow all the guidelines of this agreement and any state and local laws or regulations pertaining to auctions and/or real estate practices.
      4. Broker commission/referral will be paid at the final title closing of the property(s) purchased by the broker’s client.
      5. Only the first broker/agent who duly registers a potential bidder will be considered.
      6. The Broker/Agent will hold harmless and indemnify FourSquare Auctions and/or Thomas O Cox, Managing Broker, from any claims of their clients and/or prospects regarding this agreement.
    4. Brokers and Agents are not eligible for participation if they, their immediate family, their business partners, or their non-human entities are principals of the purchase.
  4. Broker/Agent, by their endorsement below, agrees and acknowledges that:
    1. They are appropriately licensed to participate in the auction as a real estate licensee eligible to receive a commission or referral according to the laws of Indiana or Kentucky.
    2. FourSquare Auctions and Thomas O Cox, Principal Broker, represent the seller(s) in this auction.
    3. The Buyer Broker/Agent shall hold harmless and indemnify FourSquare Auctions and/or Thomas O Cox, Principal Broker, from any representations or actions made by the Broker/Agent.
  5. This agreement is the entire understanding between the Broker/Agent and the Auctioneer. No other agreement shall be recognized, whether orally or in writing.
